Agreement to Terms

By subscribing to SnowAlert or using our website at snowalert.xyz, you agree to these Terms of Service. SnowAlert is operated by Telstar Capital LLC. If you do not agree, do not use the Service.

What SnowAlert Does

SnowAlert is a free SMS notification service. When a professional or college football or soccer game is being played in snow, we send you a text message so you can tune in. We currently cover the NFL, NCAA Football, English Premier League, and MLS.

Eligibility

You must have a valid US phone number and be at least 13 years old to use SnowAlert. By subscribing, you confirm that you are the owner or authorized user of the phone number you provide.

SMS Messaging Terms

• By subscribing, you consent to receive recurring automated SMS messages from SnowAlert at the phone number you provided.
• Message frequency varies depending on how many snow games occur. During offseason months, you may not receive any messages.
• Message and data rates may apply depending on your mobile carrier and plan.
• You can opt out at any time by replying STOP to any message.
• You can opt back in by replying START or subscribing again on our website.

No Guarantees

SnowAlert is provided “as is” and “as available.” We do our best, but we cannot guarantee:

• That every snow game will be detected or that you will receive an alert for every snow game.
• The accuracy of weather data or game schedules, which come from third-party sources.
• Uninterrupted or error-free operation of the Service.
• Timely delivery of SMS messages, which depends on your carrier and network conditions.

Cost

SnowAlert is free. We do not charge you for the Service. However, standard message and data rates from your mobile carrier may apply to messages you receive.

Acceptable Use

You agree not to:

• Subscribe phone numbers that you do not own or are not authorized to use.
• Use the Service for any unlawful or abusive purpose.
• Attempt to interfere with the operation of the Service.

Limitation of Liability

To the fullest extent permitted by law, Telstar Capital LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of SnowAlert. Our total liability for any claim related to the Service shall not exceed $0, as this is a free service.

Termination

We may suspend or discontinue SnowAlert at any time, with or without notice. You may stop using the Service at any time by replying STOP to unsubscribe.

Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify subscribers via SMS. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable federal and state law.
